Article 1 Nature and scope
This Corporate Code is applicable to BOX TRAVEL and to all companies that, having approved it, are in a controlling or group relationship with BOX TRAVEL, as well as to the Complementary Business Groups formed by these companies, without prejudice to other legal and regulatory provisions to which, by virtue of the exercise of their duties, the holders of their respective corporate bodies are obliged, as well as to permanent or occasional employees, representatives, internal and external auditors and other persons providing them services on a permanent or occasional basis are required by virtue.
Article 2 Internal Organisation
1. Internal organisation
1.1 In order to avoid the occurrence of conflicts of interest between the company and its customers, or among customers, and except where expressly permitted by law and the Board of Directors of BOX TRAVEL or of the participated companies so decide, the different activities developed, allowed by law, shall be organised and managed autonomously.
1.2 The organic structure of companies must allow, as far as possible, the assignment of employees exclusively to each activity, without interference in any other activity that may give rise to a conflict of interest.
1.3 Organic units must ensure high levels of technical competence and should have the adequate technical and human resources to provide services and to make available products and services under appropriate conditions of quality and efficiency.
2. The internal organisation shall also comply with the following principles:
2.1 The segmentation of markets and the diversification of products and services presuppose, on the part of the employees, the correct and permanent identification of the specific needs of each customer, contributing in this way to intensify the relationship with the customer and his/her loyalty.
2.2 The consideration of existing interconnections between the different specialised areas, aiming at the integral satisfaction of customers by obtaining the levels of quality and profitability that have been previously announced or contracted.
Article 3 Internal Operation and Control
1. The different areas and organic units of BOX TRAVEL and of each participated company must set the performance of their duties in full and systematic compliance with the internal control procedures adopted at each level, in particular those relating to segregation of duties, justification of technical, accounting and financial information, risk assessment and achievement of objectives, thereby ensuring the appropriate transparency of the activities carried out.
2. The treatment of personal data of customers, financiers, investors, partners, suppliers and other creditors, with or without automated means, shall be governed by the security and confidentiality rules appropriate to the risk that the treatment of personal data presents, in particular, those relating to unauthorised access.
3. For the purpose of the provisions of the preceding paragraphs, the complete physical and functional separation between business activities and the respective operational control services must be observed.
4. The different organic units must ensure that customers are treated impeccably and contribute for their satisfaction, strive to ensure fair and timely handling of their complaints, and also to arrange the organisation of the archive and documentation in order to ensure their easy handling and identification in accordance with the needs of the internal and external audit functions and in compliance with the legal and regulatory provisions in force.
5. In any case, BOX TRAVEL, as well as the companies in which it participates, such as the organic units of those companies, shall take, in internal operation and in relation to each other, the necessary measures to avoid the occurrence of conflicting situations or misuse of information, in conditions that do not conflict with the legal provisions.
6. The Company Secretary shall exercise the supervisory function of this Deontological Code and other internal regulations as well as the applicable norms and laws, carrying out permanent actions to verify and evaluate the internal control system of the company and associated companies.
Article 4 Information and Communication
1. The provision of services, compulsory or optional, to the general public, to customers in particular or to the competent authorities, shall be carried out with strict observance of the principle of legality, in particular the applicable legal provisions and specific regulatory standards.
2. Publicity about the company, the participated companies and their activities or products shall be promoted taking into account the legal discipline and specific internal regulations that apply to it.
3. In advertising or marketing actions, consumer interests shall be taken into account and the principles of truthfulness, objectivity, clarity and timeliness shall be respected.
Article 5 General Duties in the Performance of Functions
1. Employees are strictly prohibited from using for their own benefit or to the detriment of third parties any information obtained in connection with the professional activity.
2. In the performance of their duties, employees shall conduct their performance by the highest standards of personal integrity and honesty, complying with all legal and regulatory provisions in force applicable to the activities to which they are attached, as well as all professional deontological standards envisaged in the Codes of Conduct that regulate the industrial, commercial and service provision activities.
3. Employees in general and members of the management bodies in particular, as well as persons holding management, supervisory or similar positions, shall exercise with the diligence of a careful and prudent manager, in accordance with the principle of risk sharing and security of business activities, privileging the strict interest of customers, investors and the general public.
4. In the performance of their duties or in the provision of their services, employees shall:
4.1 Communicate promptly to the respective immediate superior any conflicts of interest or duties that may jeopardise the full observance of applicable standards of conduct;
4.2 Take appropriate measures within their power to frustrate practices they are aware of and that include misuse of information or constitute an infringement of current regulations, and shall immediately inform this fact to the respective immediate superior;
4.3 Observe market practices inherent to the activities they carry out, always following the strictest and most demanding ones;
4.4 Ensure, by all means at its disposal, the protection of the assets of the company and of the participated companies, as well as the assets of third parties whose management has been entrusted to them;
4.5 Maintain all information media inherent to their professional duties perfectly organised, performing the duties undertaken with transparency, good sense, effectiveness and prudence;
4.6 Ensure the conservation of the equipment and other means of work placed at their disposal, avoiding the inconvenient use of them or the occurrence of wastes and therefore contributing to the efficient management thereof;
4.7 Provide the customers and the general public with all the information requested, in harmony with the internal procedures in force and in full compliance with the strictness of professional secrecy;
4.8 Timely report customer complaints to the immediate superior, who must ensure the forwarding of the complaints in accordance with the standards that, for that purpose, are in force at the moment in the company or in the entities to which this Code applies;
4.9 Cooperate promptly with the supervisory bodies, in strict compliance with the legal limits, taking into account the scope of the specific assignments of those entities and in close connection with the audit entity, avoiding to obstruct the exercise of their functions.
Article 6 Public Statements
Employees may only make public statements, grant interviews, in particular to the media, or intervene in any other type of manifestation of the same kind that may involve BOX TRAVEL and the disclosure of facts or elements relating to the life of the company or companies in which it participates, provided they have obtained prior written authorisation from the Board of Directors.
Article 7 Normal Operating Period
1. In the normal operating period which is fixed for any organic unit, no function shall be inaccessible, inactive, or with affected responsiveness.
2. Each job holder is personally responsible for ensuring the normal responsiveness of the respective function during his/her absences or impediments, even if they are temporary, by mobilising for this purpose the forms of substitution that are superiorly established.
3. Any restriction to full compliance with the provisions of the preceding paragraphs, in particular as a result of the shortage of staff present to ensure the combination of schedules, including the lunch period, shall be reported to the immediate superior to be adequately managed.
4. In addition to the personal responsibility referred to in the preceding paragraphs, it is the responsibility of the management to ensure that the substitution processes, with adequate alternative response capacity, are guaranteed by all members of the respective teams.
5. It is prohibited to claim as a justification of the impossibility of responding, especially in relations with the outside, the limitation of the ability to decide or the impossibility of doing so based on the absence or impediment of any employee.
Article 8 Competence, Diligence and Transparency
1. Employees must contribute to ensure that all customers are given competent, diligent, impartial, transparent and discreet treatment in absolute respect of their interests.
2. With regard to transactions on products marketed and services rendered, special consideration should be given to the following:
2.1 Obtaining the best conditions that the market makes feasible to realise the sales, always respecting the instructions received from the customer;
2.2 Prompt delivery of the sales order to the relevant sectors;
2.3 The resulting savings to the customer, therefore, employees shall not perform or incite customers to make repeated purchases when they are not justified or are intended to charge commissions or reach any other purpose unrelated to the customer interest.
3. They are especially forbidden:
3.1 The sale on credit, except when authorised from above;
3.2 The sale of products and/or services for the purpose of subsequently renegotiating the price for the satisfaction of customer orders previously received.
Article 9 Equality of Treatment
Employees shall cooperate in order to ensure equal treatment for all customers and shall not discriminate between them which is not the result of the rights they are entitled to, either by virtue of the nature or priority of their work or by virtue of any other legal provisions or regulations in force.
Article 10 Prevalence of Customer Interests
Absolute priority must be given to the interests of customers, in particular in the context of sales or provision of information, both in relation to the interests of the company, whatever its nature, and the interests of its employees.
Article 11 Conflict of interests
1. All the necessary efforts shall be taken to avoid the emergence of conflicts of interest between customers, particularly at the level of sales or service provision, on advantageous terms to some at the expense of others.
2. When conflicts cannot be avoided, they shall be resolved fairly, without privileging any particular customer.
3. In order to avoid conflicts between institutions, on the one hand, and the company customers, on the other hand, employees shall bear in mind that they are not allowed, without prior knowledge and written authorisation of customers:
3.1 To act as counterparty in the transactions they carry out on behalf of customers;
3.2 To subscribe requisitions, orders, receipts or invoices on behalf of customers;
3.3 To carry out, on behalf of customers, any other operations of a similar nature that may generate some conflict of interest with customers.
4. Managers, directors and managerial staff supervisors are prohibited from developing or participating directly or indirectly in businesses whose areas of interest are conflicting with those developed by BOX TRAVEL. This ban remains valid for a period of three (3) years after the breach of its relationship with BOX TRAVEL.
Article 12 Cooperation with Customers
1. In the performance of their duties, employees shall assure customers with the following:
1.1 Clarifications and information leading to reasoned, consistent and informed decisions regarding the quality of products and services provided;
1.2 Prompt and timely information on the execution and results of the operations carried out on behalf of the customer and on the occurrence of special difficulties or the impossibility of their realisation, in addition to any other facts or circumstances not subject to professional secrecy and which, by itself, can justify the amendment or revocation of orders or instructions they have formulated;
1.3 For the purpose of what is established in the preceding paragraph, the level of knowledge, experience and professionalism of customers, on the one hand, and their position in the market, on the other hand, shall be considered.
Article 13 Rules of Conduct
1. In the performance of their duties, BOX TRAVEL employees shall base their performance on the highest standards of personal integrity and honesty, complying with all legal and regulatory provisions in force applicable to the activities to which they are attached.
2. In particular, BOX TRAVEL employees assume the obligation to adopt certain standards of conduct, materialised in particular through the following duties:
2.1 Duty of responsibility – BOX TRAVEL employees are responsible to the respective heads or competent social bodies to respect the applicable legal and internal regulations;
2.2 Duty of professionalism – BOX TRAVEL employees, at all times during their activity, shall dedicate their best effort to the tasks entrusted to them, continuously seeking to improve and update their knowledge, with a view to the maintenance or improvement of their professional capacities and the improvement of the functions they perform;
2.3 Duty of integrity – BOX TRAVEL employees shall refrain from receiving any kind of gratuity from third parties, as well as from adopting behaviors that may create in their interlocutors favouring expectations in their relations with BOX TRAVEL, or with associated companies;
2.4 Duty of independence – BOX TRAVEL employees shall conduct their relations with third parties with the utmost seriousness and impartiality, defending the best interests of BOX TRAVEL;
2.5 Duty of confidentiality – BOX TRAVEL employees shall keep absolute confidentiality in respect of all facts concerning the life of the company of which they are aware in the performance of their duties, or because of them, in order to avoid disclosure of facts and information which, in any way, could damage BOX TRAVEL, and its associated companies or partners. Likewise, such employees shall not use this information for personal or third-party benefit.
3. This Deontological Code complies with the principle of subsidiarity, that is to say, its observance does not prevent the simultaneous application of the specific rules of conduct of other professional groups as well as of the specific regulations of the specialised directorates or departments.
Article 14 Specific Duties
1. Regardless of the rules of conduct mentioned in paragraph 2 of the previous article, BOX TRAVEL employees recognize the existence of specific duties whose respect is essential for the proper operation of the company.
2. Amongst the specific duties, whose existence is recognised, the following are highlighted:
2.1 Duty of communication – Even if this is not prohibited by their personal status or contractual relationship, BOX TRAVEL employees shall participate to their respective directorates or administrations any other professional activities they may carry out. The communication must take place before the beginning of the activity in question and the supporting document must be filed with the individual process of the employee;
2.2 Duty of loyalty – BOX TRAVEL employees shall put all their knowledge and skills into the tasks entrusted to them, as well as act with loyalty to coworkers, refrain from making improper comments on them, in order to cultivate and maintain a correct and cordial relationship among all, to develop and strengthen a strong team spirit and cooperation;
2.3 Duty of parsimony – BOX TRAVEL employees shall make a careful use of the assets entrusted to them in the scope of their duties, avoiding waste. Likewise, they shall not use, directly or indirectly, any assets of the company for the personal or third party's benefit;
2.4 Duty of weighing – BOX TRAVEL employees shall refrain from invoking their professional quality in situations outside the company, where such invocation is contrary to the interests of the company, as well as acting in the performance of their duties and beyond, so as to call into question the public image of the company.
Article 15 Other Duties
1. BOX TRAVEL employees in general and those whose activities are in direct contact with the public, in particular, shall contribute to ensuring that all customers are treated in a competent, diligent, impartial, transparent and discreet way, with absolute respect for their interests.
2. BOX TRAVEL employees in general and those whose activities are directly linked to the relationship with third countries, in particular, are prohibited, and shall strive by all means within their power, to publicly make considerations or make comments of a political or religious nature on those countries and, especially, they shall respect cultural differences, habits and customs. Failure to comply strictly with the provisions of this paragraph is considered a very serious and punishable offense.
3. Whenever, in the course of their activities, BOX TRAVEL employees are called upon to intervene in decision-making processes involving, directly or indirectly, organisations with which they collaborate or have collaborated, or persons to whom they are or have been linked by kinship or affinity, they shall communicate the existence of such links to their respective supervisors.
4. Whenever, in the exercise of their activity, BOX TRAVEL employees are required to enter into contractual relations with natural or legal persons providing services, namely partners, they shall demand and control for strict compliance with this Deontological Code and of the other norms and regulations existing in the company as well as of all applicable legal provisions.
5. BOX TRAVEL employees, who in any capacity have acquired relevant information capable of influencing the position of the company in the markets where it operates, such as estimates of results, significant acquisitions or partnerships, the taking or loss of large contracts, during the period prior to the respective disclosure, they shall not:
5.1 disclose this information to third parties;
5.2 transact securities of the company or associated companies, strategic partners or companies involved in transactions or relationships with BOX TRAVEL, which constitute or may constitute in the future relevant facts.
6. The principle of non-discrimination based on (ancestry) ancendant, gender, race, language, territory of origin, religion, political beliefs, and unionisation shall be observed in the relations between the corporate bodies of the companies associated with BOX TRAVEL, its partners and its employees, as well as in the relations between employees with one another. Failure to comply strictly with the provisions of this paragraph shall be considered a very serious and punishable offense.
Article 16 Commitments and Links
In the relations between the corporate bodies of the companies associated with BOX TRAVEL, its partners and its employees, as well as in the relations between these employees with one another and with third parties, only written acts, duly authorised, will be taken into account for commitments and links of any type that empower BOX TRAVEL. Verbal agreements are excluded.
Article 17 Disciplinary Action
1. The violation by BOX TRAVEL employees of the deontological rules contained in this Code constitutes a disciplinary offense punishable under the applicable disciplinary regime, without prejudice to civil, administrative or criminal liability that may occur.
2. The members of the corporate bodies and other employees of BOX TRAVEL are obliged to provide all the information requested to them in connection with the initiation of disciplinary proceedings and in relation to the facts connected with them, in compliance with applicable legal and regulatory provisions.
Article 18 Commitment to Fund Providers
Fund Providers allow BOX TRAVEL to finance its activities. Therefore, BOX TRAVEL commits itself to:
■ ensure the continuity of the company;
■ achieve a sound return on own funds in the long term, which is proportionate to the extent of the risk in the sector;
■ provide relevant information in due time;
■ take all necessary measures to prevent transactions not permitted by law.
Article 19 Our conduct with regard to subcontractors
Subcontractors provide BOX TRAVEL with products and services that BOX TRAVEL uses in its activities. Therefore, BOX TRAVEL commits itself to:
■ select and subcontract based on generally accepted market principles;
■ pay competitive market prices and set reasonable requirements;
■ establishing a lasting and stable relationship, sharing of value, quality, in competition and reliability;
■ pay on time for the products and services as agreed;
■ promote openness and reliability in all its activities;
■ maintain the integrity of the relationship by not accepting invitations or favours that might jeopardize this principle.
Article 20 Liability
1. Those who steer on the basis of an effective implication, and considering the activities and the position of BOX TRAVEL regarding this Deontological Code, an open and diligent attitude can be expected from BOX TRAVEL.
2. Consequently, BOX TRAVEL is, where applicable, responsible for the proper application of this Deontological Code. Moreover, BOX TRAVEL also commits itself to examine all requests, suggestions and fair claims.
Article 21 Declaration of Honour
At the commencement of functions, all BOX TRAVEL employees must sign a declaration of adherence to this Deontological Code. Subsequently, and at such intervals as may be fixed, they shall declare that, in the meantime, no violations of the principles and duties established therein have occurred.
Article 22 Other Provisions
1. Should a BOX TRAVEL employee violate simultaneously the norms provided in this Deontological Code and other norms of professional deontology to which he/she is legally bound, this Deontological Code shall only apply when the alluded rules to which the employee is bound are less demanding than those provided for in this Deontological Code, safeguarding that the professional status of the employee, in cases where it has the force of law, does not oppose that.
2. This Deontological Code shall enter into force in each company on the day immediately following its approval by the respective Board of Directors, without prejudice to each one adopting, for its own scope, specific and complementary rules to that code.
3. The Board of Directors reviews this Deontological Code every two years.

TERMS AND CONDITIONS
Clause 1 The Participant and the Event
1.1 The Terms and Conditions outlined represent a contract between the Participant and the event organizer, herein after referred to as Organizer, for participation in the international event, herein after referred to as Event.
1.2 By completing the event registration form and clicking the 'Send Information' button, the Participant agrees to the Terms and Conditions.
1.3 As the interaction between participants is a key part of the Event, the Organizer has created specific participant profiles to ensure a high-quality experience for everyone.
Clause 2 Event Scope
This event aims to bring together agricultural operators, farmers, agronomists, researchers, specialists in food biotechnology, specialists in composite materials, agro-food industry operators, nutritionists, business associations, chambers of commerce, builders of equipment for the extractive industries, builders of equipment for cutting and polishing basalt as ornamental and decorative stone, Universities, industries, importers and exporters of basalt products, environmentalists, financial institutions, relevant national, regional and international experts, and other interested parties to participate in accordance with the programme, as well as the generalities of economic and development agents in all sectors of human activity legally permitted.
Clause 3 Registration Confirmation
3.1 The Organizer reserves the right to void the participant registration if the Participant fails to make payment within 30 days of the request date.
3.2 Upon receipt of full payment, the Organizer will issue a registration confirmation by email within seven working days.
3.3 Event participation without payment is not possible.
Clause 4 Event Documentation
Upon arrival at the event, the participant will receive a complete package with the event documentation.
Clause 5 Event Directory
Unless participant states otherwise at the time of registration, the Organizer will display participant name and details in the Event Directory.
Clause 6 Press Releases
6.1 Representatives of Press and Media will be present during the Event. As such, the Participant grants the Organizer the right and unrestricted permission to use the Participant’s name, image, voice, words or any other item related to the Event in any photo, video recording, audiotape or digital image, taken or made on behalf of the Organizer or its partners.
6.2 The Participant agrees to release to the Organizer complete ownership of such material and grants the Organizer use of said material for any purpose consistent with the Organizer’s mission. Uses include but are not limited to advertisements, press releases, publications, videos, websites, and any publicity or promotional materials in any medium. The Participant acknowledges that they will not receive any compensation for the use.
Clause 7 Governing Law
These Terms and Conditions shall be governed in accordance with the laws of Cabo Verde without reference to conflict of laws principles. You acknowledge that these Terms and Conditions are solely for Your benefit. It is not for the benefit of any other person, except for Your successors and permitted assigns.
Clause 8 Payment
The Organizer accepts payments by bank transfer, bank deposit or credit card. Details are specified on all invoices issued by the Organizer. The Organizer does not accept payment by cheque. Please note the following:
8.1 All prices are quoted in Euros;
8.2 All payment transactions are made in Euros, US Dollars or Cabo Verde Escudos (CVE);
8.3 For converting currency into Euros, US Dollars or CVE, the reference exchange rate is indicated by the Central Bank of Cabo Verde (www.bcv.cv);
8.4 Exchange expenses, if any, will be on the participant's account.
Clause 9 Insurance
The Organizer advises the Participant to take a comprehensive travel insurance policy. The Participant should ensure that they have adequate medical, liability, personal accident or other insurance to cover them for the full duration of their trip. The Participant is responsible for their health and safety throughout the duration of the Event. The Organizer does not accept any liability.
Clause 10 Cancellation
10.1 - Cancellation by the Organizer
10.1.1 Should circumstances arise outside of the control of the Organizer that requires the cancellation of the Event, participant registration fees will be fully refunded.
10.1.2 The liability of the Organizer in the case of cancellation will not exceed the total amount paid by the Participant to the Organizer in respect of the registration fee.
10.1-3 The Organizer strongly advises all participants to take out a comprehensive travel insurance policy. The Organizer does not accept any liability for loss of travel, accommodation or other expenses incurred due to the cancellation of the Event. Further, the Organizer does not accept liability for any loss including but not limited to incidental or consequential damages.
10.2 - Cancellation by the Organizer
10.2.1 - Transfer of a participant’s registration to a colleague: a substitute participant is allowed per registration. Any transfer must be confirmed in writing to the Organizer through helpdesk@boxtravel.eu up to 7 business days prior to the first day of the Event.
10.2.2 - Cancellation of a participant’s registration: cancellations must be requested in writing to helpdesk@boxtravel.eu. Any cancellation must be confirmed by the Organizer by sending an email back to the Participant for registration to be deemed cancelled.
Clause 11 Administrative Charges
An administrative charge will be applied to refunds resulting from the cancellation of a participant’s registration as follows:
11.1 - Cancellations made up to 30 days before the start of the Event are subject to a 5% administrative charge penalty;
11.2 - Cancellations made between 14 and 7 days before the start of the Event are subject to a 50% administrative charge penalty;
11.3 - Cancellations made less than 7 days before the start of the Event are subject to a 100% administrative charge penalty;
For the purposes of paragraphs 10.1 to 10.3 of this Clause, the start date of the event indicated in the program, should be considered the first day of the event.
Clause 12 Registration from abroad
12.1 If the Participant is a resident outside of the ECOWAS or European Union (EU), it is the sole responsibility of them to ensure that they have a valid travel visa and comply with all the immigration requirements prior to submitting the registration request.
12.2 Once payment has been made, cancellation charges are applied in accordance with our Terms and Conditions.
12.3 If any participant does not hold valid travel documentation or visa, or does not meet the immigration requirements, and therefore is unable to participate in the Event, the Organizer reserves the right to levy the full cancellation charges.
12.4 Visas can be obtained from any Cabo Verde diplomatic representation abroad or upon arrival at Cabo Verde airports. The cost of the visa is paid directly to the competent authorities. If necessary, the Organization may assist participants in the procedures for obtaining Visas.
12.5 For Visa invitation letter, if necessary, please send an email to helpdesk@boxtravel.eu.
Clause 13 Force Majeure
Except for payment obligations, neither the Participant nor the Organizer will be liable to the other for damages arising out of delays or failures to perform under this Terms and Conditions, if any such delay or failure to perform hereunder is caused by factors beyond the reasonable control of the party so affected.

PREAMBLE
If there is contradictory information on the website in relation to references to continents, countries and territories, and their names and symbols as well, the definitions and concepts adopted by the United Nations shall prevail.
Throughout the website, Tourism Code means the Tourism Code and all applicable international directives and standards.
One. Organizer: Designates BOX TRAVEL, a tout operator bssed in Cabo Verde.
Two. Buyer: Designates any person booking, ordering and/or purchasing a service proposed by the Organizer, such as providing airline tickets, accommodation, car rental, tourist packages or any other type of service.
Three. Group: Products offered on the BOX TRAVEL website are intended for individual customers with a maximum of 9 (nine) persons per file. Above 9 (nine) persons, the file is a group and is therefore subject to a special charge and its reservation must be done through the email booking@boxtravel.eu, or on-line, through the website itself.
Four. Flight:É"Flight" means a simple air service.
In the case of selling air transport tickets or regular transport tickets not accompanied by services connected with such transport, one or more tickets for the entire journey, issued by the carrier and under the responsibility of the carrier, shall be delivered to the Buyer. Full liability as defined by law shall not apply to reservations or sale operations, whether or not carried out on-line, not forming part of a tourist package, as defined in the Tourism Code, relating to air tickets or other regular transport tickets.
Five. Duration of the offer: Proposals to sell trips made through the BOX TRAVEL website, subject to the present sale conditions, are, in normal conditions, valid while remaining in line until all available seats are exhausted, and may vary in real-time. Offers and prices can be updated at any time by the service providers, regardless of the Organizer's will.
Six. Tourist Packages: In the sale of tourist packages, BOX TRAVEL intervenes as a travel organizer and is subject to all applicable laws, in particular the laws and regulations applicable in each country or territory where it develops activities, intermittently or regularly:
Six.1 — Tourism trips are those in which at least two of the following services are combined:
■Transport;
■Accommodation;
■Non-subsidiary tourist services for transport and accommodation.
Six.2 — Organized trips are tourist trips which, by previously combining at least two of the following services, are sold or offered for sale at an all-inclusive price, when they exceed twenty-four hours or include a night:
■Transport;
■Accommodation;
■Non-subsidiary tourist services for transport and accommodation, in particular those relating to sports, religious and cultural events, provided that they represent a significant part of the journey.
Six.3 — Tailor-made trips are trips prepared at the request of the customer to satisfy its pretences.
Six.4 — Tourist trips are not considered trips in which the agency merely acts as an intermediary in sales or reservations of services requested by the customer.
Six.5 — The possible separate billing of the various elements of an organized trip does not affect their legal qualification or the application of the respective regime.
Seven. BABY: Designates a minor who, at the time of travel, has not yet completed 2 years of age. When travelling, it does not occupy a place, it is accompanied by an adult person, over 18 years old, paying a variable percentage of the adult fare.
Eight. CHILD: Designates a minor who is more than 2 years and less than 12 years of age on the date of trip, travelling with a person over 18 years of age. During trip, occupy a seat, discounting a variable percentage of the adult fare.
Nine. YOUNG: Designates a minor who on the date of travel is over 12 years of age and has not yet reached 18 years of age. The minor travels without an escort and with assistance in flight, if necessary. The minor travels at a discounted rate in relation to the adult rate.
Ten. Users: Designate the persons or organizations that access the website, whatever the reasons and interests.

PREAMBLE
BOX TRAVEL intervenes as a travel organizer, designing and marketing tourist packages, and acts as an intermediary between buyers and suppliers in sales of simple services, namely airline tickets, cruises, accommodation, rent-a-car and also in the organization and promotion of events of a tourist nature. These tourist products are likewise marketed through the Internet, providing buyers and consumers in general with competitive prices, simplicity and convenience in planning and making their trips through a simple access to the BOX TRAVEL website
To use the website, the Buyer expressly accepts full and unreserved adherence to each and every one of the Selling Conditions of BOX TRAVEL, in the version published and in force at the moment he accesses this website, especially those established on limitation of liability, as well as those of any tourist or travel service provider. Therefore, the Buyer must carefully read the Selling Conditions before using the website, as they may be updated periodically.
Step 1 The Buyer selects the product(s) he wants, indicates the dates, the intended destination, the number of participants according to the category (adults, children, babies) and the flight class (tourist or business), and he can also choose the company in which he wants to travel with. Once these elements are indicated, the Buyer launches the automatic search.
Step 2 BOX TRAVEL displays the search result.
Step 3 BOX TRAVEL displays the elements of the selected product (s) and the Buyer adjusts the product (s) to his own needs in terms of flight times, departure and return dates, as well as the corresponding price.
Step 4 In addition to a recapitulation of the selected product, the Buyer who makes the order must indicate his personal coordinates.
Step 5 BOX TRAVEL presents the order budget corresponding to the sales contract; the Buyer must indicate precisely the data and coordinates of the beneficiaries of the contracted service(s). This data will be used in the issuance of travel tickets, therefore, the Buyer must necessarily know the Selling Conditions, validate an electronic signature and expressly accept the Selling Conditions presented. The Buyer may also specify any special requests he may wish.
Step 6 The Buyer chooses the means and form of payment intended.
Step 7 BOX TRAVEL sends an acknowledgement of receipt indicating that the reservation is being processed. That acknowledgement of receipt summarizes the essential elements and the file number. BOX TRAVEL will transmit to the Buyer the order confirmation, summarizing the essential elements (the reserved service, the price, the quantity, the dates of the outward and return journeys, flight schedules, the name of the beneficiary of the service, among other useful information).
The absence of such a document means that the reservation has not been taken into account. In accordance with applicable law, the order and the order confirmation shall be deemed to have been received when the parties to whom they are addressed have access to them.
Step 8 SSL (Secure Page): The Buyer proceeds to pay for his order. The last click materializes the final validation of the sales contract. This acceptance is made in the name and on behalf of all the beneficiaries of the contracted products and services.
Step 9 Once the payment has been confirmed, the corresponding invoice / receipt will be issued and sent to the Buyer electronically or by post mail. The request should be made at the time of ordering for the latter case.
Step 10 Upon formalization of the contract, BOX TRAVEL will keep the Buyer informed about any and all changes that it may be aware of and that change the conditions at the order date of the product(s) and/or service(s). The absence of any communication from the Organizer means that there is no change or the Organizer is not aware of any change to the basic contractual conditions.
An order is a request whereby the Buyer asks the Organizer to perform the service and as such has no definitive confirmation value. The Organizer informs the Buyer that the order has been well registered so that it can be processed. The file will be considered reserved and confirmed after payment validation.
1. ELECTRONIC BILLING
1.1 When making a purchase, the Buyer is giving his express consent to the sending of the invoice in electronic format by BOX TRAVEL. The sending will be encrypted form with an appropriate electronic signature, which includes the entire contents of the invoice.
1.2 This service does not imply any additional cost to the Buyer. In case the Buyer wishes to receive a duplicate in paper, it will be sent without cost and can be requested by sending an email to booking@boxtravel.eu or by post mail to the headquarters of BOX TRAVEL, whose address can be found on the contact page of this website.
1.3 The Buyer must make sure that he receives an acknowledgement e-mail and to do so he should check his e-mail box regularly. If the Buyer transmits incorrect coordinates in one of the elements of his order or is negligent, no liability can be attributed to BOX TRAVEL.
2. DATA PROTECTION
The Buyer, expressly and clearly, consents to the transfer of his data collected from the airline to finalize the transaction. This transfer authorization occurs prior to any definite confirmation of the reservation. This data transfer takes place in accordance with the legal provisions in force. The personal data provided by the Buyer for the use of the website is subject to the privacy policy contained in the link "Data Protection" inserted in the homepage of the website.

De acordo com o regime do IVA sobre a margem das Agências intermediárias, as facturas emitidas pela Organizadora não mencionam o IVA colectado sobre as prestações efectuadas ou vendidas.
As Autoridades locais de certos países podem impor a aplicação de taxas locais suplementares. Nos casos em que isso venha acontecer, tais taxas são suportadas pelo Comprador e o pagamento no destino será feito em qualquer moeda convertível. Os preços são estabelecidos na base das tarifas e das taxas de câmbio do dia e podem ser revistos ou alterados.
Salvo menção expressa contrária na descrição da oferta, os preços não incluem:

1.4.- Para as prestações aéreas: as taxas de saída de território reclamadas por certos países, a serem pagas no destino em moeda ou numerário, no momento do check-in; os excessos de peso de bagagem; os parques de estacionamento nos aeroportos; os vistos e despesas inerentes às formalidades administrativas e sanitárias necessárias à realização da viagem; vacinas, tratamentos médicos e ainda todas as demais taxas legalmente exigíveis. Caso a caso a BOX TRAVEL fará todos os possíveis para de tais situações informar previamente e com a urgência possível, aos compradores, sempre que as mesmas ocorram;
1.5.- Para as prestações hoteleiras: As taxas de estadia exigidas em certos países; as taxas locais ou outras taxas suplementares que possam ser impostas pelas autoridades locais de certos países, o seu pagamento será feito localmente em moeda local ou qualquer outra moeda; o suplemento de quarto individual; as refeições não incluídas na fórmula escolhida durante a estadia e as refeições consumidas durante as escalas; todas as bebidas inclusive durante as refeições, as garrafas de água minerais consumidas; a quota-parte relativa aos bebés a pagar localmente junto dos hotéis (suplemento); as comunicações telefónicas, fax e Internet (quando não expressamente mencionadas como isentas); as visitas e excursões não expressamente contratadas; as entradas nos parques temáticos; nos museus e nos monumentos; nas exposições; as actividades extra- programam previamente definidas; quaisquer despesas de carácter pessoal; as gratificações exigíveis em certos países; as gorjetas habituais ao guia e/ou ao motorista.
3. Para todas as prestações, os preços incluem:
3.1.- As taxas de aeroportos, nacionais e internacionais;
3.2.- Os custos de serviço dos fornecedores, ou seja, os custos inerentes às prestações encomendadas e os custos suportados pelos fornecedores.
4.0.-Revisão dos preços.
Os preços indicados são os preços em vigor na data da reserva. Os preços são estabelecidos com base nas tarifas e taxas de câmbio do dia. Os preços são susceptíveis de serem revistos e devem ser confirmados pela BOX TRAVEL antes de qualquer confirmação por parte do Comprador.
Para os compradores com pacotes turísticos já confirmados, a revisão do preço da sua viagem não pode ser alterado a menos de trinta dias da data da partida.
Em caso de variação do valor das taxas, taxas passageiros e/ou sobretaxas de combustível aplicadas pelas autoridades competentes e/ou companhias aéreas, estas sobretaxas serão imediata e integralmente repercutidas sobre o preço de todos os produtos a partir da data da sua comunicação formal, e inclusive para os compradores já confirmados e com as respectivas prestações já pagas
. 5.0.-Formas de pagamento
A BOX TRAVEL disponibiliza ao comprador várias alternativas de pagamento das suas encomendas.
A BOX TRAVEL pode vir a exigir em qualquer momento que o pagamento por transferência bancária seja a forma privilegiada dos pagamentos dos Compradores. As despesas relativas a esta operação de transferência bancária ficam a cargo do Comprador. As coordenadas bancárias transmitidas no momento da encomenda são encriptadas de acordo com as normas em vigor.
A BOX TRAVEL pode vir a solicitar ao Comprador fotocópia do cartão de crédito utilizado para o pagamento da encomenda, assim como cópia do documento de identificação do titular do cartão de crédito e do passageiro e bem como o envio prévio do ”Mail Order”. Na ausência de resposta por parte do Comprador ou na impossibilidade de o contactar directamente dentro das datas limite previstas para a viagem, o pedido não será processada e o pedido de reserva será anulado com os custos para o “Comprador”.
5.1.- Por cartões de crédito e de débito
A BOX TRAVEL aceita cartões bancários de crédito e de débitos nas suas Agências de Viagens, no seu Site Internet ou no momento de uma reserva feita por telefone, designadamente:

Aceita-se ainda todo e qualquer outro tipo de Cartões de Crédito ou de Débito, aceites expressamente por qualquer Banco do 7º CONTINENTE e/ou que a Direcção Financeira possa autorizar ao Comprador no acto da encomenda.
5.2.- Por transferência bancária.
A Organizadora aceita pagamentos por transferência bancária, que deve ser imperativamente confirmada por documento do Banco Emissor. Essa confirmação de transferência bancária deve ser enviada ao Serviço Financeiro da BOX TRAVEL por fax ou por e-mail, e cujas coordenadas serão transmitidas no momento da confirmação da encomenda. Na confirmação da transferência bancária deve figurar o nome, o apelido e o número da encomenda. A confirmação deve ser transmitida antes do dia da data de viagem ou da prestação do serviço, e a data da opção sendo definida como a data limite de encerramento do dossier de reserva.
A encomenda somente será satisfeita após confirmação do bom pagamento por parte do Banco Receptor e as despesas relativas à transferência bancária, assim como as despesas de câmbio, caso as haja e que serão suportadas pelo Comprador.
As moedas de referências dos nossos preços são o Euro e/ou Dólar Americano.
5.3.- Em numerário.
O numerário é um instrumento de pagamento indispensável e eficiente, aceite pela BOX TRAVEL e pelas empresas do seu Grupo, sem restrições e nos termos da Lei. O pagamento em numerário é aceite pela BOX TRAVEL em qualquer moeda convertível, em euros e em dólares americanos, sendo sempre as moedas de referência dos nossos preços e serviços o Euro e/ou o Dólar Americano. Todas as despesas de conversão serão suportadas pelo Comprador.
O Comprador deve obrigatoriamente fornecer prova do seu depósito na Conta Bancária indicada pela BOX TRAVEL antes de beneficiar de qualquer prestação dos serviços por parte desta, e directamente nas instalações da Organizador ou enviando-a por fax a indicar ou para o endereço e-mail: finance@boxtravel.eu. Na falta da prova do depósito as prestações não serão efectuadas.
A BOX TRAVEL aceita o pagamento das suas prestações em espécie monetária e em moeda nacional de qualquer País ou Território onde a mesma esteja presente ou representada e exercendo as suas actividades, desde que não lhe seja vedada a possibilidade de efectuar a conversão dessas mesmas moedas para o Euro ou o Dólar Americano e sejam as despesas dessa conversão suportadas pelo Comprador.
5.4.-Por Cheques-Brinde
.
O Organizador aceita o pagamento através de Cheques-Brinde a BOX TRAVEL ou de quaisquer outros que venham a ser adoptados pela mesma, nos termos e condições da legislação aplicável. O Comprador pode utilizar os seus Cheques-Brinde :
5.4.1.- Directamente na Agência da BOX TRAVEL, sendo que as despesas de tratamento do dossier serão deduzidas do valor total dos Cheques-Brinde;
5.4.2.- Por excepção, após passagem de uma encomenda online ou por telefone, efectuando uma reserva fazendo uso do seu Cartão de Crédito ou de Débito. Uma vez feito o pagamento, o Comprador transmite a BOX TRAVEL os seus Cheques-Brinde, e necessariamente antes da data de viagem, via correio postal com aviso de recepção, fazendo referência ao seu dado pessoal, e nomeadamente o nome, apelido e número da encomenda, dirigida a BOX TRAVEL, para a morada inserida no seu Site.
O Comprador pode optar por pagar uma parte ou a totalidade da sua encomenda por Cheques-Brinde a BOX TRAVEL. Após a recepção do pagamento dos Cheques-Brinde, a BOX TRAVEL compromete-se a reembolsar o valor dos Cheques-Brinde por cheque bancário ou por crédito sobre o cartão bancário, deduzindo as despesas de tratamento da encomenda. Caso a totalidade da encomenda seja paga com cheques-brinde e se o valor do pagamento exceder o valor da encomenda, então o excedente não será devolvido. Em caso de anulação, será creditado o valor da viagem e nunca o valor dos Cheques-Brinde entregues.
5.5.- Normas de segurança nos pagamentos.
As informações relacionadas com a encomenda do comprador serão processadas automaticamente. A não disponibilização dos dados relacionados com a sua encomenda impede a BOX TRAVEL de a realizar e bem como a análise da encomenda. Alguns dados não pessoais relacionados com a encomenda, como é o caso do endereço IP, podem ser objecto de utilização nos termos definidos na nossa Política de Protecção de Dados.
Em caso de insuficiência de dados do Comprador ou com as conclusões resultantes da análise do dossier da encomenda, a BOX TRAVEL reserva-se o direito de satisfazer ou não a encomenda efectuada pelo Comprador.
5.6.- Condições de pagamento.
O pagamento é uma condição essencial do contrato, podendo a encomenda ser anulada por falta de pronto pagamento. A anulação da encomenda aplica-se a qualquer rejeição de pagamento, independentemente da causa. A BOX TRAVEL não é obrigada a executar a sua prestação antes da recepção e da cobrança do pagamento integral. O Comprador é responsável pelo pagamento de todos os montantes acordados para os produtos e/ou serviços encomendados.
Não são considerados como quitação da dívida dos montantes acordados: a entrega, pelo Comprador, de um cheque bancário antes da boa cobrança do mesmo; a entrega de um número de cartão bancário enquanto a autorização do centro de pagamento não for formalmente obtida, nem de uma transferência bancária antes da confirmação do banco do Comprador, e com a efectiva creditação na conta bancária indicada pelo Organizador.
5.6.1 Reserva definitiva:
Uma inscrição torna-se efectiva imediatamente após a efectivação da reserva. Contudo, uma reserva somente é definitiva após o pagamento total devido pelo Comprador.
5.6.2 Para todas as prestações:
Para todas as inscrições a prazo de mais de trinta dias antes da data da partida: pagamento (sinal) de um depósito mínimo de 25% (vinte e cinco por cento) do valor total da viagem. O saldo poderá ser pago em prestações de acordo com a conveniência do Comprador, sendo que tudo deve ficar integralmente pago o mais tardar 30 dias antes da data de partida.
5.6.3 Quitação efectiva da dívida.
Somente é considerada quitação efectiva da dívida, total ou parcial, o pagamento devido pelo Comprador de uma prestação da BOX TRAVEL quando a mesma receber o pagamento efectivo da prestação encomendada seja directamente pelo Comprador ou seja através de quaisquer intermediários. Com o não pagamento pelo Comprador ou pelos intermediários nos prazos acordados, a BOX TRAVEL pode exercer o seu pleno direito de anular a reserva efectuada pelo Comprador ou por qualquer intermediário em representação deste. Sem receber a totalidade do pagamento o Organizador não é obrigado a executar qualquer prestação contratualizada
. 5.6.4 Viagens organizadas:
Todas as viagens organizadas pela BOX TRAVEL, adquiridas com mais de 21 (vinte e um) dias antes da data da partida usufruem da garantia e do direito de as poderem cancelar com uma pequena penalização, sem ter que apresentar qualquer motivo e até 15 (quinze) dias antes da data de início da viagem.
5.6.5 Anulação da reserva:
Casos em que o Comprador não respeite as condições de pagamento acordado, pagamentos feitos de forma irregular, pagamentos incompletos ou ausência de qualquer pagamento, independentemente das razões que possam ser apresentadas será considerado pela BOX TRAVEL como sendo um pedido de anulação formulado pelo Comprador, devendo as despesas associadas ser por conta do Comprador.

TRAIN AND RENTAL CARS
PREAMBULE
As part of the purchase of rail services or car rental services, BOX TRAVEL acts as an intermediary between buyers and suppliers, providing buyers with a complete solution for their holiday, leisure and business trips.
1. 1. RAIL TRANSPORT
1.1 Where rail transport is included in a supply of services, the use of transport tickets shall be subject to the strict conditions of their use indicated in the transport tickets themselves. Changes to itineraries or conditions of use of the transport title must be subject to prior permission of the Organizer. Should any modification occur at Buyer's request or due to force majeure, for events not attributable to either the Organizer or the supplier, the Buyer shall bear any costs or fees that may be incurred.
1.2 The Buyer must inform itself of the rules and regulations of the transporter in matter of transport of baggage.
1.3 Any beneficiary of a reduction in the price of the transport ticket must prove this quality.
1.4 Possession of the transport ticket throughout the journey is a requirement that the Buyer must necessarily satisfy. The buyer must present his transport document whenever requested to do so by any agent of the supplier or by the competent authorities.
1.5 The Buyer is aware that the responsibilities of the transporter are overseen by the international conventions governing rail transport. In addition to international conventions, the applicable national legislation of each country shall be in force, which must necessarily be taken into consideration by the Buyer.
2. CAR RENTAL
2.1 By providing a car rental service, the Organizer intervenes as an intermediary between the supplier and the Buyer, thus, the Buyer is subject to the rules and regulations of the supplier.
2.2 Upon taking possession of the vehicle, the Buyer must submit to the supplier the respective Voucher, thus avoiding double invoicing. If the Voucher is not presented, the Buyer shall be solely responsible for all expenses resulting there from.
3. VOUCHER AND COLLATERAL
3.1 After confirmation of the payment due by the Buyer, a Voucher is sent to him, who must give it to the supplier upon receipt of the vehicle.
3.2 The Buyer, or whoever acts as the driver of the vehicle, must prove to the supplier that he is legally qualified to do so by presenting its valid driving license.
3.3 Presentation of a Collateral
The presentation of a collateral by the Buyer to the supplier, at the time of receipt of the vehicle, is strictly necessary. The amount of the collateral, which is intended to guarantee any damage caused by the Buyer to the supplier, will be refunded at the end of the contract if there is no discharge to be made, and is dependent on the category of the vehicle taken and the additional guarantees subscribed.
BOX TRAVEL can not be held liable for facts that are unrelated to it and that in any way jeopardize, against its will, the effectiveness of initiatives organized and promoted by the company, such as natural disasters, strikes, bad weather, social turmoil, wars, epidemics, attacks, technical incidents, among others, and including situations of force majeure caused by any third party. Nevertheless, the Organizer shall take all necessary preventive measures with a view to minimizing any adverse effects to the Buyer, should such situations arise.
